BASTROP COUNTY, Texas (KEYE) — Yet another lawsuit has been filed against the driver of the concrete pump truck, as well as the company and CEO, who crashed into a bus full of pre-K students in Bastrop County last month.

This lawsuit, the seventh filed this month, was filed by the parents of Ryan Wallace, a 33-year-old man who was driving behind the bus. The FJM Concrete Pumping truck hit Wallace’s car, killing him.

They are seeking monetary relief “in an amount significantly above $1,000,000.” They also “respectfully demand a trial by jury.”

Without cause or justification, Defendant [Jerry] Hernandez crossed the double yellow lines on SH 21 and drove into oncoming, westbound traffic on SH 21. Defendant Hernandez struck Mr. Wallace’s vehicle at a high rate of speed, killing Mr. Wallace.

Hernandez confessed to consuming cocaine the morning of the crash. The night before, he only got several hours of sleep.

The lawsuit states that Hernandez was a “highly dangerous driver who never should have been allowed to drive a concrete pump that day.” It says his negligence caused the crash.
