It should always be the contractors job to make sure the crew and the equipment on the job are safe and protected. This has to be the contractors fault but I bet the pump company will have some liability but I do not believe they should. |

I think as a operator you should also make sure that you are setting up in a safe spot. That pump should not have been set up until the road was coned off. Operator, car driver and contractor are all at fault.

Looks like a rear ender to me! Not a 100% sure, but, where I live the one doing the rear ending is as fault. Even if lead vehicle slams on there brakes. Your charged with following too close or undo care and attention. The police officer was kind enough to let me decide which one of these charges I would like! |

I dont see how cones would of prevented this. I doubt that outrigger jumped out in front of the car. If they didn't see that big ass outrigger they wouldnt of seen the cone. |
